Samama Terms and Conditions

Introduction

Terms of Use: You must read the following terms and conditions ("Terms and Conditions") before accessing the website located at https://samama.qa/ and all websites linked to https://samama.qa/ (hereinafter referred to as the "Site") in any way, download, install and use the Samama application ("Application") or use it in any other way, use any other software provided by Samama ("Software") (the Site, Application, and other software hereinafter referred to as the "Platform"), or access or use any information, services, features or resources available or found via the Platforms on any iOS, Android or other supported electronic device.


The Samama Platform activity is legally owned by Aqmar for Management Consultancy, Training and Technology LLC, a limited liability company registered in the State of Qatar with commercial registration number 199002 (hereinafter referred to as "Samama"). It enables Order Services transactions (as defined below) to take place on its Platform between participating local and international merchants and Users (as defined below). Users can select and place an order (as defined below) from a range of products and services listed and offered for sale by Partner Merchants (as defined below).


In connection with the above, Samama enables the provision of Delivery Services (as defined below) by connecting with Delivery Partners (as defined below), who are responsible for providing pickup and delivery services for orders, as initiated by Partner Users/ Merchants on the Platform.


Samama is not a manufacturer or distributor of the products and services listed on the Platform, but simply facilitates the process of placing an order on behalf of the User to the Partner Merchant in accordance with the contract of sale and purchase of goods and services between the User and the Partner Merchants, as regulated by the Civil Law No. 22 of 2004 of the State of Qatar.


For the avoidance of doubt, Samama acts solely as an intermediary to facilitate transactions between Users and partner merchants and/or delivery partners (and/or anything related thereto). It is specifically clarified that the Service Providers (as defined below) are independent contractors and are free to determine how they operate.

Samama does not exercise any control over the Service Providers. The relationship between Samama and the Service Providers is not one of agent and principal, employee and employer, or joint venture partners.


Acceptance: These Terms and Conditions constitute a legal and binding agreement between Samama and the User. By installing, downloading or using the Platform, the User has entered into a contract with Samama and is deemed to have read, understood and accepted the Terms and Conditions and agreed to be bound by them.

If these terms and conditions (or any part of them) are unacceptable, that person must not access or use, or continue to access or use, the Platform.

In any case, Samama reserves the right to suspend or terminate access to or use of all or any part of this platform at any time, without any liability to the user and/or any other person.


Updates to these Terms and Conditions: Samama reserves the right to update, change or replace any part of these Terms and Conditions by posting updates and/or changes on the Platform, with or without notice to users.

Any new features or tools added to the Platform shall also be subject to these Terms and Conditions. Any new version of these Terms and Conditions will be effective and will govern the use of the Platform and the User's relationship with Samama, immediately upon uploading such revised version on the Platform. The User's continued use/access to the Platform following the posting of any change constitutes acceptance of those changes.


Definitions


For the purpose of these terms and conditions:


"Account" shall have the meaning set forth in Section 6.1 of these Terms and Conditions.


"Affiliates" shall mean any natural person, corporation, partnership, limited liability company, association, fund, unincorporated entity or other legal entity that directly, or indirectly through one or more intermediaries, controls, is controlled by or is under common control with Samama.


"App" refers to the Samama app.


"Applicable Laws" refers to all laws, regulations, guidelines and legal or governmental notices issued by the State of Qatar.


"Authorization Violation" refers to any cancellation or attempted cancellation of the Order by the User constitutes a violation of the irrevocable and unrevised authorization in favor of Samama to place the Order on behalf of the User's business partners.


"Data Protection Legislation" includes (a) Qatar law and (b) any legislation in force from time to time relating to privacy and/or the processing of personal data applicable in connection with the provision and receipt of Training under these Terms and Conditions.


"Delivery Partners" includes any third-party service provider, whether an organization or an individual, that partners with Samama to provide pickup and delivery services for orders, as initiated by users/business partners on the Platform.


"Delivery Services" means any pickup and delivery services provided by Delivery Partners for orders placed by Users/Business Partners on the Platform in Qatar or abroad.


"Feedback" refers to any ideas or suggestions sent to Samama through the Suggestions, Feedback, Articles, Forum or similar pages.


"Ordering Services" refers to services advertised and marketed by Business Partners, including, but not limited to, (a) automotive tools, (b) consumer goods, and (c) other products and services available for ordering by the User on the Platform that may or may not be accepted by Business Partners in their sole discretion.


"Order" refers to a request for Order Service made by a User on the Platform.


"Merchant Partners" includes all organizations and merchants, including but not limited to hardware stores, auto and phone accessory stores, home improvement stores in general, who are involved in connection with the Ordering Services. The term "Merchant Partner" can refer to any of them.


"Privacy Policy" refers to Samama's privacy policy.


"Service Providers" includes and refers to business partners and delivery partners.


"Samama Materials" means any products, images, photographs, images, including any person represented in the images, illustrations, icons, texts, videos, audio clips, written materials and other materials owned by Samama or its subsidiaries and protected by legislation such as copyright and trademark legislation and under the provisions of international treaties and national laws worldwide.


"Services" means the services provided by Samama on the Platform, including Ordering Services and Delivery Services.


"Sensitive Information" includes a customer's private information, including but not limited to debit card numbers and credit card numbers.


"Terms and Conditions" refers to these terms and conditions.


"User" or "Customer" refers to anyone who accesses or uses the Services to share, view, host, post, publish, transact, or upload information, opinions and images.


"User Content" has the meaning given to it in clause 6.1 of these Terms and Conditions.


"We" refers to Samama.


"You" refers to a user.



Representation and guarantees


The User's request to purchase products and services from a Merchant Partner by clicking on the "Place Order" tag (or any other button indicative of placing an order) on the Merchant Partner's page on the Platform will constitute an unconditional and irrevocable authorization issued by the User in favor of Samama to place online orders for services against the Merchant Partner and the relevant Delivery Partner on behalf of the User. When an order is placed on behalf of the User by Samama and accepted by the Merchant Partner, the order constitutes a separate contract of sale of goods under Law No. 22 of 2004 on the publication of the Qatar Civil Code or any successor legislation between the Merchant Partner and the User, to which Samama is not a party.


The Platform is provided to the User at Samama's sole and absolute discretion. Samama does not represent that all features available in the Application will also be available on the Website, or vice versa.


By using the Platform in any way or taking any action that indicates your acceptance of the Terms and Conditions (including accessing or using the Platform), or completing the account registration process, you (the "User") represent and warrant that:


- I have read, understood and agree to comply with these Terms and Conditions and any future amendments and additions to these Terms and Conditions, as posted from time to time on https://samama.qa/ or through the Services.


- You are eighteen (18) years of age or older.


- you are able to enter into a legal agreement.


- You are not legally barred or otherwise prevented from accessing the platform in the jurisdiction in which you reside.


- You have the authority to enter into the Agreement personally and, if applicable, on behalf of any company, organization or other legal entity named as a User during the Samama account creation process and to bind that company, organization or entity to the Terms and Conditions.


- Your participation in the use of the Services is for your personal or internal business use. When using the Services, you agree to comply with all applicable laws of your country of origin and the country, state and city in which you reside while using the Services.


- You may access the Services only using authorized means. It is your duty to check to ensure that you have downloaded the correct software for your device. Samama is not responsible if you do not have a compatible device or if you download the wrong version of the Software for your device. Samama reserves the right to terminate your use of the Software and/or Services if you use the Software or Services with an incompatible or unauthorized device.


By using the Services, you agree to the following:


  - You will use the Services only for lawful purposes; you will not use the Services to send or store any illegal material or for fraudulent or deceptive purposes.

  - You will not use the Services to cause annoyance or harassment.

  - You will not use the Services or any content accessible through the Services for commercial purposes, including, without limitation, contacting, advertising, marketing, selling to, or selling to Service Providers or contacting the User or any other third-party contractor, unless Samama has given you permission to do so in writing.

  - You will not copy or distribute the Software or any content viewed through the Services without prior written permission from Samama.

  - You will not create or compile, directly or indirectly, any compilation, supplement or other evidence of any content displayed through the Services except for your personal, non-commercial use.

  - The information you provide to us when you create an account or communicate with us in any way is accurate, and you will promptly notify us of any changes to that information and provide us with any proof of identity that we may justifiably request from you.

  - You will retain the account password or any identification data we provide to you that enables you to access the Services securely and confidentially.

  - You will use the Services solely for your personal use and will not sell the Program, Services or purchased food to a third party.

  - You will not use the Platforms or Software in any way that could damage any Samama server or networks connected to any Samama server.

  - You will not attempt to access any part of the Platform and/or any service, account, resource, computer system and/or network connected to any Samama server without authorization.

  - You will not deep dive or access the Platform manually or use any robot, spider, extraction software, automated processes and/or device to pull, copy or monitor any part of the Platform or any content on the Platform, unless Samama grants you permission to do so in writing.

  - You will not copy any content displayed through the Services, including without limitation the content of provider listings and reviews, for republication in any form or media.

  - You will not perform any systematic retrieval of data or other content from the Platform, Software or Services.

  - You will not attempt to harm other users, Samama, the Platform, the Program, or the Services in any way whatsoever.

  - You will report any bugs, software errors, unauthorized access methods, or any infringement of intellectual property rights that you discover while using the Platform, Software, or Services.


User account


Access authorization:

You expressly agree that Samama may, through automated means, access your mobile device messages and mobile phone number and retrieve and use information from your messages to provide you with enhanced services from Samama or its affiliates. For example: A one-time password OTP is the OTP provided for the "two-step verification" procedure. By allowing us access to your messages, you understand that we may access the OTP from the message received on your mobile device, fill it out and send it to Two-Step Verification.

Accuracy of information:

You agree that any registration/user content information you provide to us will always be true, accurate, correct, valid, complete and up-to-date. Any phone number used to register on the Platform must be registered in your name, and you may be required to provide supporting documentation to prove this. Users understand and agree that Users are responsible for the accuracy of all information they provide to obtain the Services.


The User shall ensure that the details such as contact number, delivery address etc. are accurate and correct when placing the order. By providing these details, the user expresses their agreement to Samama's terms and conditions and privacy policy.


We reserve the right to suspend or terminate your account and access to the Services if:


- any content submitted by the user during or after the registration process proves to be inaccurate, non-current or incomplete.

- if you believe that your actions may create legal liability for you, other users, or us; and/or

- If you are found to be non-compliant with these Terms and Conditions.

 

Using the platform

Services:

Through the Platform, Samama will provide you with a portal to order an online product or service of your choice provided by Merchant Partners. Users can access the ordering services provided by the Merchant Partners listed on the Platform and place an order to the Merchant Partners through the Platform which the Merchant Partners may accept or reject based on their own choice.


orders:

When you order a product or service via our Platform, you will receive a notification from Samama on behalf of the Business Partner confirming that your order has been received and accepted by the Business Partner (the "Confirmation Email"). The contract for the provision of any (a) customized or printed product, (b) consumer goods, and (c) other products and services is solely between you and the Business Partner and will only be created when we send you the Confirmation Email. Please make sure to provide a valid email address as we will communicate with you about your order through it. Please also make sure to provide a valid address and phone number to ensure that the order services are delivered to the right place. If you do not open the door or answer the phone within 5 minutes of our delivery partners arriving at your address, we reserve the right to leave the premises, and you will be charged for the product.


User content:

Samama may offer you interactive opportunities through the Services, including, for example, the ability to post user ratings and reviews. You represent and warrant that you are the owner of, or in any way possess the right to, all User Content that you submit, post, transmit, or otherwise make available through the Services. You hereby grant Samama a perpetual, irrevocable, transferable, fully paid-up, royalty-free, non-exclusive, worldwide, fully sublicensable license to use, copy, display, publish, modify, remove, publicly perform, translate, create derivative works, distribute and/or otherwise use the User Content in connection with Samama's business and in all forms now known or hereafter invented (Uses), without notice and/or consent from you. You also grant Samama a license to use your username and/or other user profile information, including but not limited to your rating history, to attribute User Content to you in connection with such Uses, without notice or consent from you.


Notes:

You agree that any submission of ideas, suggestions and/or proposals to Samama through proposal pages, submissions, article pages, forums or similar pages (Feedback) is at your own risk and that Samama has no obligations (including, without limitation, obligations of confidentiality) with respect to such Feedback. You represent and warrant that you have all necessary rights to provide such Feedback and hereby grant Samama a perpetual, non-retroactive, transferable, fully paid-up, royalty-free, non-exclusive, worldwide, fully sublicensable license to use, copy, display, publish, modify, remove, publicly perform, translate, create derivative works, distribute and/or otherwise use such Feedback.


Evaluations and reviews:

With respect to ratings and reviews that you are asked to provide for service providers or other businesses ("Ratings" and/or "Reviews"), such content is considered User Content and is subject to these Terms and Conditions. Ratings and Reviews are not endorsed by Samama and do not represent the opinions of Samama or its affiliates. Samama is not responsible for the Ratings and Reviews or any claims of economic loss arising from such Ratings and Reviews.


As we endeavor to maintain a high level of integrity with respect to ratings and reviews posted or otherwise made available through the Services, you agree that you:


- Any rating or review will be based on the personal experience of the service provider or business.

- You will not provide a rating or review of any service or business provider in which you have a financial interest, or other business, employment or affiliation relationship, or any competitor of this company.

- You will not provide a rating or review in exchange for payment, free food items, or other benefits from a service provider or business.


Checkout

Prices:

to understand that:


- All commercial/contractual terms are offered and agreed upon between the User and the Service Providers only with respect to the products and services offered by them. The commercial/contractual terms include without limitation: Price, applicable taxes, delivery charges, payment terms, delivery date, delivery period, delivery method, warranties related to products and services, and after-sales services related to products and services. Samama does not have any control or role in determining or directing any kind of such commercial/contractual terms between the user and the service providers. However, Samama may provide support services to Service Providers in relation to order fulfillment, payment method, payment collection, customer service center, and other accompanying services, in accordance with separate contracts executed between Samama and the relevant Service Providers. The price for the products and services provided by the Merchant Partners is determined by the Merchant Partners themselves, and Samama has no role in determining the price in any way.


Samama takes care to validate all prices listed when they are published, as received from trading partners. The total price of the products and/or services ordered, including delivery and other costs, will be displayed on the Platform when you place your order.


The prices for Listing Items offered through the Services may differ from prices offered or published by Merchant Partners for the same Listing Items and/or from prices available on other third-party websites, and may not be the lowest prices at which the Listing Items were sold.


Samama has no obligation to itemize its costs, profits or margins when publishing such prices. 


Samama reserves the right to change these prices at any time, at its discretion. You are responsible for all transaction taxes on services provided under these Terms and Conditions (excluding taxes based on Samama's income). Payment will be made by Samama, using the preferred payment method designated in your account.



Promotions:

Samama and/or Merchant Partners may, in their sole discretion, offer promotions with different features and different prices to any of our users. These promotions, unless offered to you, do not in any way affect your offer or contract. However, the validity and verification of such offers will be subject to the compliance of the service providers/payment partners/third parties, and Samama assumes no responsibility for such offers.


Loyalty points program:

Samama, at its sole discretion, may offer a loyalty points program to Users. Details of the program are subject to modification from time to time. Points will be allocated for each order placed. Points may be exchanged for payment for services on the Platform and/or other benefits/discounts on the Platform, subject to the conversion rate/terms of the offer, as may be amended from time to time by Samama.


Rewards Program Policy

1. Overview:

Samama's Tasks feature is designed to increase customer engagement by offering activities or "tasks" that customers can do to earn coupons as rewards. The feature is divided into four sections: Active, Coming, Finished, and Rewarded, based on the status and qualifications of the tasks for the customer.

2. Mission elements:

Each task includes unique elements such as sponsor information, image, color, title, short and detailed description, and duration (if applicable). If there is a reward for the task that the customer can claim, a "Get Reward" button is shown.

3. Definition process:

For customers who are new or haven't interacted with the feature, an induction process is offered to guide them on how to participate in tasks. Customers must confirm their participation in this feature when they first open the app; without confirmation, customers will not be able to participate in tasks or claim rewards.

4. Bonus notifications:

The system regularly checks and informs customers of any new rewards they can claim through their participation in tasks.

5. Legal compliance:

The Tasks feature is subject to defined terms and conditions, compliance with Qatar's promotional activity laws and regulations, and a customized privacy policy for handling user data.

6. Conclusion:

By participating in the Tasks feature, customers agree to abide by the terms and conditions, including compliance with laws and promotional regulations, and acknowledge the privacy policy for the handling of their data.

7. Policy updates:

This policy is subject to updates and changes. Customers will be notified of any changes to the policy.

Coupon codes

Vouchers / coupon codes / offers / memberships can be used by the user based on the terms and conditions specified by Samama and/or partner merchants, from time to time. Samama may promote its new offers/membership plans etc. through the Platform and/or other means of communication. Unless otherwise specified, all coupon codes / promotions / offers are subject to the following additional terms and conditions:


- All coupon codes/promotions are single-use only.

- The voucher value does not include fees related to delivery services.

- The amount specified in the code/offer cannot be exchanged for cash or credit card.

- Canceled orders that have been paid (in full or in part) with coupon codes/offers cannot be replaced with credit or cash.

- The coupon/promotion code can only be used once per order.

- The validity of the coupon/offer is limited and may vary in each case.

- If the user does not redeem the full amount of the coupon/offer, the same coupon/offer cannot be used again to redeem any balance.

- Samama reserves the right to cancel or modify any order or withdraw the use of Vouchers for any reason, including due to suspicious purchasing activities or misuse of Vouchers, including the use of multiple accounts or multiple payments associated with the same customer or group of customers; or the use of the Voucher in bad faith.


Software and service fees

Samama may change the fees for the Services as it deems necessary or appropriate for the Project.


Payment method

We accept online payment through a third party including, but not limited to, Visa, MasterCard, Almahfaza (as defined below), Paylater, Apple Pay, Google Pay and CWallet. By placing an order on the Platform, you warrant that:

- All information provided to us by you for payment is accurate and correct.

- The account you use to pay for the Service has sufficient funds to cover the full amount of the transaction, is active and has not expired or been canceled. 

- You are the owner (or authorized user) of the account you use to pay your order, and you authorize the full transaction amount of your order to be charged to your designated account.


All payments for purchases made on the Platforms may be made through third-party e-commerce vendors. If you pay with a credit card, we may perform a basic preliminary check on your payment card to verify that there are sufficient funds to complete the transaction If your card issuer declines or does not approve the payment for any reason, you will receive immediate notification of this during the checkout process. Your payment method may also be declined if:

- The payment invoice submitted did not match the bank's records.

- Your card has expired or has been canceled by the issuing bank; or

- A potential fraud or security issue has been detected on your card.


After successful payment completion, your credit card or account (as applicable) will be charged for the full amount of the transaction. "Successful Payment Completion" means that the following has occurred:

- Confirms and advances your purchase.

- We accept your operation.

- If you pay with a credit card, we perform an introductory check on your card successfully.

 

Modify and cancel the order

Modification of orders will only be accepted if the Service Provider agrees to it. In case such modification is not accepted, the user must not cancel the order. As per the cancellation policy as outlined below, the user can cancel the order if:

- Not being able to contact you via your phone or email.

- Lack of availability of products and services on the list.

- Providing false information.

- Deliver the wrong order.

- The ordered products and services were damaged or the packaging was opened during delivery.

- The quantity of some items from the user's order has expired.


Lack of access to the customer

In case the delivery partner reaches the delivery address provided by the user on the platform in a timely manner and is unable to reach the user within 5 minutes, the order will be considered delivered and will be returned to the business partner. No refunds will be available in the above-mentioned case.


Third-party service providers


You acknowledge and agree that Samama facilitates the hosting of products and services offered by service providers and that Samama does not:

- makes any warranties, whether express or implied, as to the quality of the products and services provided by the Service Providers.

- Recommends or confirms that a particular product or products and/or services offered or provided by the provider conform to a particular quality or are labeled in a particular format.

- assumes no liability if the products and services provided by the Service Provider do not conform to the User's expectation or if the User suffers any loss or damage, including any bodily injury as a result of the use of such products and services.

- assumes any liability in case of change, modification or substitution of products and services provided by the Service Provider.


Samama will not evaluate the suitability, legality or capability of any service provider.

Samama is not responsible for the food preparation or safety of the participating company and does not verify compliance with applicable laws or regulations.

Samama has no responsibility or liability for the actions of third-party service providers, except as provided herein.


You may be required to provide sensitive information to authorized payment gateways while making a payment. In this regard, you agree to provide your card details correctly and accurately to the authorized payment gateways to avail the Services. The information you have provided will not be used for any third party unless it is done in connection with fraud verification or under law, regulation or court order. You will be fully responsible for the security and confidentiality of your card details. We expressly disclaim all liabilities that may arise as a result of any unauthorized use of your card.


The Platform is not equipped or authorized to conduct any financial transaction. All payments will be made through the payment gateway. Samama will make payments received through the payment gateway or other authorized payment system to the Merchant Partners. The receipt for such payment will be issued directly to you by the Merchant Partners. Please be sure to request an invoice from the Merchant Partners.


We do not recommend any service provider. In addition, although these terms and conditions require you to provide accurate information, we do not attempt to verify, nor do we check if an identity is fraudulent. 


You agree not to attempt to impose liability on us or seek any legal remedies on our part with respect to any acts or omissions of the Service Provider. 


Third-party websites and apps and third-party advertising


The Services may contain links to third party websites ("Third Party Websites"), third party applications ("Third Party Applications") and third party advertisements ("Third Party Ads") (collectively, "Third Party Websites and Ads"). When you click on a link to a Third Party Site, Third Party Application or Third Party Ad, Samama will not warn you that you have left the Samama Platform or the Services and will not warn you that you are subject to the terms and conditions (including privacy policies) of another website or destination. These third-party websites and advertisements are not under the control of Samama. 


Samama is not responsible for any third party websites and advertisements. Samama provides these third-party sites and advertisements only as a convenience and does not review, approve, approve, monitor, endorse, warrant, or make any representations regarding these third-party sites and advertisements, or their products or services. You use all links in third-party websites and advertisements at your own risk. You should review the applicable terms and policies, including privacy policies and data collection practices of any third-party websites or third-party applications, and make such inquiries as you deem necessary or appropriate before proceeding with any transaction with a third party.


Legal compliance by trading partners

The User acknowledges that Samama has no responsibility for compliance with legal rules, regulations and licenses by Service Providers. The User agrees that Samama will not be liable in any way if the User is unable to take advantage of the offers provided by the Service Provider due to the Service Provider's violation of any legal rule, regulation or legal license.


Fraud or unauthorized use

You will be fully responsible for any unauthorized access or use of your personal or financial information through your account, including any loss, damage or claim you suffer or make against any of the Service Providers and/or Samama, due to or resulting from such unauthorized use/access. To help you prevent unauthorized use of your account, you must comply with the security measures we recommend. If you believe that your account has been accessed or used in an unauthorized manner, please contact the Samama Contact Center at 33000587.


Use and protection of intellectual property rights

The Platform is owned and operated by Samama. The visual user interfaces, graphics, design, compilation, information, computer code (including source code and object code), products, software, services, and all other elements of this Platform provided by Samama are protected by the copyright, patent and trademark laws of the State of Qatar, international conventions, all intellectual property rights and related property, and applicable laws. 


As between you and Samama, all Samama materials, trademarks, service marks and trade names contained in the Platform are the property of Samama. You agree not to remove, obscure or alter the copyright, patent or trademark notices of Samama or any third party attached to, accessed or used in conjunction with this Platform. Except as expressly authorized by Samama, you agree not to sell, license, distribute, copy, modify, modify, publicly perform, display, publish, edit, adapt, create derivative works from, or otherwise make unauthorized use of Samama materials.

Please note that by doing so, you irrevocably authorize and irrevocably assign to Samama all rights, titles and interests in all ideas and suggestions and any associated global intellectual property rights. You agree to perform any acts and execute any documents that may be reasonably necessary to perfect the foregoing rights.


Compensation

You agree to indemnify, save and hold harmless Samama from all claims, losses, damages, obligations, costs and expenses, including without limitation, legal fees and expenses, arising out of or in connection with:

(a) your use or misuse of the Platform; (b) any violation by you of these Terms and Conditions or any other policies applicable to your use of the Platform; or (c) any violation of the representations, warranties, and covenants you have made herein. Samama reserves the right, at your expense, to assume the exclusive defense and control of any matter in which you must indemnify Samama, including the right to settle, and you agree to cooperate with Samama in the defense and settlement of such claims. Samama will use reasonable efforts to notify you of any claim, action or proceeding brought by a third party subject to the foregoing indemnification upon becoming aware of it. This paragraph shall survive the termination of these Terms and Conditions.


Privacy and communication

Privacy Policy: Our information collection practices on the Platform, such as the types of information we collect about visitors on the Platform and the ways in which we use that information, are governed by the provisions of our Privacy Policy.

Data transfer: Samama may share your payment-related information with banks, third-party service providers and service providers who are required to carry out operations, process payments and promote services.

Data protection: Samama offers the use of a secure server for transactions made by customers on the platform. All sensitive information provided is transmitted and encrypted to the database of our payment gateway providers. This information is only accessed by persons authorized with special access rights to these systems and this sensitive information is kept confidential. Sensitive information will not be monitored on our servers and will be used in compliance with data protection legislation.

Your submissions and unsolicited communications: This section relates to communications that you send to Samama. It does not relate to communications to provide personal information to Samama in connection with customer inquiries or use of services through the Platform. These matters are governed by the rules set forth in our Privacy Policy. Any unsolicited communication or material you transmit to Samama via the Platform or via email or other means, including without limitation, any data, questions, answers, comments, suggestions or the like will be treated as non-confidential and non-proprietary by Samama. By submitting communications to Samama, you automatically grant to Samama a worldwide, royalty-free, perpetual, irrevocable and exclusive license to use, reproduce, modify, publish, edit, translate, distribute, perform and display such communications alone or as part of other works in any form, medium or technology whether now or hereafter known and to obtain licenses similar to these rights for anyone else. Anything you transmit may be used by Samama and its affiliates for any purpose, including, without limitation, reproduction, disclosure, transmission, publication, broadcast, posting, posting, commentary, or the development, manufacture and commercialization of products using such information.


Limits of responsibility

In no event shall Samama or its affiliates, contractors, agents, licensors, partners or suppliers be liable to you for any special, indirect, incidental, incidental, punitive, exemplary, consequential, reliance or exemplary damages arising out of or related to:

(a) these Terms and Conditions and all other policies that apply to you; (b) the Services and the Platform; or (c) your use or inability to use the Platform, even if Samama or an authorized Samama representative has been advised of the possibility of such damages. In such cases, Samama's liability will be limited to the maximum extent permitted by applicable law. This paragraph will survive the termination of these Terms and Conditions.


Samama shall not be liable in any way for any acts or omissions by service providers including service defects, wrong order delivery or food quality, or the time it takes to prepare or deliver the order etc.


Furthermore, we will not be liable for any business loss (including loss of profits, revenue, contracts, expectations of savings, data, reputation or wasted expenditure) or any other indirect or consequential loss that could not have been reasonably foreseen by the parties at the time of commencement of use of the Platform.


You understand that the responsibility for any violation of the Human Food Control Regulation Act No. 8 of 1990 (as amended) and applicable rules and regulations rests entirely with the user. You understand that some foods may only be suitable for certain age groups. The User must check the food they are ordering and read its description, if available, before placing the order on the Platform. Samama will not be liable if the food ordered by the User does not comply with their dietary requirements or any other requirements and restrictions.


Samama will not be responsible in any way for any in-person interactions with representatives or employees of the Service Providers or the user experience at the Service Provider's outlet. Samama will not be liable in any way if any Service Provider's outlet is temporarily or permanently closed. Samama will only take care of claims and liabilities that arise from offers and membership plans advertised exclusively by Samama.


We expressly disclaim all liabilities that may arise as a result of unauthorized use of credit/debit cards. You understand that services from third parties are available on the Platform. We may form partnerships or alliances with some of these third parties from time to time to facilitate the provision of certain services to you. However, you understand and agree that at no time do we make any representations or warranties about third party services, and we will not be liable to you or any third party for any consequences or claims arising out of or relating to such third parties including, but not limited to, any liability for death, injury or damage suffered by you or any third party. You hereby expressly waive and release any rights and claims you may have against us in connection with the Third Party Services.


The list of products and services offered on the Platform is provided on an "as is" basis. We and/or our employees do not make any warranty or representation regarding the quality, timing, content, packaging, efficiency of service, wrong order delivery, delay in order fulfillment or delivery, damage to the order, etc.


In no event shall we be liable for any damages (including, without limitation, direct, indirect, incidental, incidental, special, consequential or exceptional damages, damages for personal injury/false death, damages for loss of profits, loss of data or business interruption), resulting from any services provided by any service provider via the Platform, whether based on warranty, contract, tort (including negligence) or any other legal theory and whether or not we are aware of the possibility of such damages. However, we will attempt to refund any amount paid by the User, at our sole discretion, and our liability in this regard, if any, will be limited to the extent paid by the User for the relevant booking on the Platform.


Samama attempts to ensure that the information provided is accurate and complete. However, Samama does not warrant or represent in any way that the platform is accurate, error-free or trustworthy or that the use of Samama materials will not violate the rights of third parties. 


Samama does not warrant that the functional and/or technical aspects of the Platform or Materials provided by Samama will be error-free or that Samama, the Samama Materials or the servers that make them available are free of viruses or other harmful components. If the use of the Platform or Samama Materials results in the need to service or replace property, materials, equipment, data, or any other item, Samama is not responsible for those costs. Without limiting the foregoing, everything on the Platform is provided to you "as is" and "as available" to the fullest extent permissible under applicable law, without warranty of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, merchantable quality, fitness for a particular purpose, reasonable care and skill, or non-infringement. Samama and its suppliers make no warranty about Samama's materials, software, text, downloads, graphics, links, or about the results that may be obtained from the use of the Platform.


To the maximum extent permitted under applicable law, Samama shall not be liable for any indirect, incidental or consequential damages in any way resulting from or relating to the use of the information available on the Platform or any liability for loss of use, business interruption, loss of profits, loss of data, or any other indirect or consequential loss not reasonably foreseeable by the parties at the time of commencement of use of the Platform.


Things out of control

If Samama's performance under this Agreement is prevented or restricted due to labor disputes, acts of strike, natural conditions, floods, lightning strikes, extreme weather conditions, material shortages, rationing, distribution restrictions, government embargoes, pandemics, virus, Trojan or other sabotage mechanisms, any incident of hacking or illegal use of the Platform, failure in public services or communications, earthquake, war, revolution, terrorist acts, civil unrest, acts of public enemies, blockade, export ban, or any law, order, proclamation, proclamation, regulation, ordinance, requirement, demand or requirement that has the legal effect of any government, jurisdiction or representative of such government, or any other event whatsoever, similar to those referenced in the foregoing, or any other event whatsoever. in force, decree, requirement or demand having legal effect from any government or any jurisdiction or representative of such government, or any other event whatsoever, whether similar or dissimilar to those referred to in this clause, which is beyond the reasonable control of Samama and cannot be prevented by reasonable precautions, Samama will be excused and relieved from performing such performance to the extent and during the period of such Force Majeure Events, and such non-performance shall not be deemed a breach in any way by Samama of its obligations hereunder.


Termination and suspension

These Terms and Conditions shall be governed by, construed and enforced in all respects in accordance with the laws of the State of Qatar. You irrevocably consent to the exclusive jurisdiction of the courts of the State of Qatar in connection with any action to enforce these Terms and Conditions, or to recover damages or other relief for breach or violation under these Terms and Conditions, or for any other cause of action arising under these Terms and Conditions.


Exemption

Samama's failure to exercise or enforce any right or provision in these Terms and Conditions will not constitute a waiver of such right or action. Any waiver of any provision of these Terms and Conditions will only be effective if it is in writing and signed by Samama.


Detachable part

If any provision of these Terms and Conditions is held to be invalid or unenforceable, that provision will be severed from the remaining Terms and Conditions and will not affect the validity, enforceability or enforceability of the remaining provisions.


Cancellation policy

⦁ In case you change your decision after creating the order and decide to cancel the order, you can do so in a timely manner by clicking "Cancel Order" before the trading partner accepts the order. You will not be charged for the canceled order and the amount paid for the order will be refunded.


⦁ If you decide to cancel the order after the trading partner has accepted the order, you will not have the option to "cancel the order" on the platform. However, you can still cancel the order by contacting the Samama Customer Center and providing a brief description of the reason for the cancellation. Samama will decide in its sole discretion whether the order should be canceled based on the reason for cancellation. If Samama accepts your order cancellation, you will receive a full refund of the amount paid.


⦁ All refunds will be processed in the same manner as the payment was made unless refunds are made available to the user in the Wallet. Any refunds made will be returned to the Wallet within 24 hours of the order being canceled.


If the payment amount is refunded to the user's credit card, debit card or Apple Pay, Samama will quickly initiate the refund process with the user's bank. The time it takes for the refund to appear in the bank account can typically range from 3 to 7 business days. This timeframe depends on the bank's processing time and its own policy.


It is important to note that if part of the order is paid using the wallet, the user cannot request that this part of the money be transferred to their credit card. Instead, the refund will be credited to the wallet. Usually, we submit the refund request to the bank within a time frame that lasts up to 24 hours.


⦁ The User should be aware that any alleged cancellation or attempted cancellation of the Order after sending the Delivery Partner to the Trading Partner for delivery of the Order. Such request will constitute a violation of the User's irrevocable authorization in favor of Samama to place such order to the Business Partner on behalf of the User ("Authorization Violation"). In the event that the User commits a Breach of Authorization, the User will be liable to pay agreed damages in an amount equal to the value of the Order. The User shall be obligated to authorize Samama to deduct or collect the amount due as agreed damages by such means as Samama may decide in its sole discretion, including but not limited to, by deducting such amount from the payment under which the User's next order was placed.


Fees paid by you for completed and delivered orders are final and non-refundable. Samama has no obligation to provide refunds or credits, but may grant them, in each case at Samama's sole discretion.


Missing or partially canceled item

⦁ If an order is received with a missing item, the user has the right to order a new item or receive a refund in the following cases:


⦁ If Samama believes that the order placed by the User contains a missing item and the User has been notified of the missing item by Samama's Customer Service Center.

⦁ If the User receives an order and discovers that an item is missing from the order and the User notifies Samama's Customer Service Center of the missing item and such notification is verified and accepted by Samama.

⦁ In the above cases, the user has the option to receive a partial refund equal to the cost of the lost item in the user's wallet or to receive a replacement for the lost item. However, if the user created the order by paying in cash, and there are missing items, the customer will have to pay the difference between the order and the value of the missing item.


Return policy

⦁ How do I start the return or exchange process?

   To start the return or exchange process, simply contact our customer service. All you need is your Samama receipt and order number. If you don't know the order number, you can usually find it in the list of orders in your Samama account on your Samama website. If you can't find it, you can contact us via customer service.


Ability/eligibility for the return process

   Before contacting our customer service, please follow these guidelines to make sure your order is eligible for return:

   - Returned items must be unopened.

   - Returned items must be returned in perfect condition, with the original packaging and all accompanying paperwork.

   - Returned items should not show obvious signs of use or wear.

   - Due to health and safety reasons, the following items cannot be returned or exchanged:

     - Swimwear

     - Lingerie

     - Women's underwear

     - Hair Accessories

     - Cosmetics

     - Earrings

     - Candles, oud, incense or any products derived from them

     - Perishable items such as liquids, glass, etc.

     - Products sold as sets (meaning a purchase consisting of several items and sold as a whole) cannot be exchanged or refunded individually.

     - Toys for babies and toys for private personal use.


   - After contacting us, an investigation case will be opened in coordination with the merchant. Upon acceptance of the return request by the merchant, we will process the return and issue a refund.


   - All refunds will be disbursed according to the following schedule:

       - Bank account (QNB to QNB) 48 hours

       - Bank account (from QNB to another bank): 3-10 business days

       - Debit/credit card: 3-10 business days

      - PayLetter: 3-10 business days

   - Refunds for products purchased at promotional prices are based on the same purchase price.


   Healthcare products:

- All healthcare products ordered from the platform can be returned within 7 (seven) days from the date of delivery.

- Ineligibility for return: Products will not be eligible for return in the following cases:

- If the item has been opened, partially used, or deformed.

- If the product is damaged by water or stored in improper conditions.

- If the product packaging, packing box, or seal has been tampered with.

- If it is stated on the product details page that the product is non-returnable.

- If the accessories or free gifts that came with the product are missing.

- If the product does not have a serial number, UPC code or barcode label, which was present at the time the products were received by the delivery agent.

- If the damage or defect is not covered by the manufacturer's warranty.

- If the product is without its original packaging and free accessories/gifts.

- If the product is damaged due to improper use.

- Please note that the decision to accept the return of health products is subject to the business partner's professional judgment. Therefore, it is highly recommended to check the delivery package carefully before accepting it from the delivery agent.


Products related to personal care, childcare, food and nutrition, essential healthcare products related to Covid including but not limited to masks and gloves, sexual health products including but not limited to condoms and pregnancy/fertility kits, any other product such as but not limited to baby diapers, health drinks, nutritional supplements, medical meters, glucose strips, medical monitoring devices, etc: are generally non-returnable. Notwithstanding anything else to the contrary, said products may be returned if they are found to be defective, deficient, counterfeit, do not conform to the attributes or features as advertised or are delivered after a delay.


Flowers and a balloon:

The following items are non-refundable:

- Flowers: We cannot accept returns on damaged items due to their perishable nature.

- Balloons: Due to their delicate nature, we cannot accept returns or exchanges of balloons.


electronics:

- Return eligibility:

- Our return policy applies to all eligible electronic products purchased through the platform.

- To be eligible for return, the item must be in its original condition, including all packaging materials, manual and accessories.

- Returns are not accepted for items that have been damaged, altered or tampered with after delivery.


- Return Period:

- You can initiate the return of the item within 7 (seven) days from the date of delivery.

- After 7 (seven) days, the item will be considered a final sale and will not be eligible for return.


- Return Procedures:

- For any after-sales requirements, including repairs, maintenance and warranty claims, customers should directly contact the Trade Partner's store or authorized service center for the purchased electronics.

- We can assist you by providing information and facilitating contact with the relevant authorized service center, but we are not obligated to pick up the item and deliver it to the Trading Partner's store once the delivery is completed.

- Users are responsible for following the return procedures and directions provided by the business partner store or authorized service center.


- Warranty:

- Warranty coverage for electronics is covered by the trade partner's store or manufacturer, as specified in the product description or documentation.

- Customers should refer to the warranty terms and conditions provided by the trade partner store or manufacturer for details on coverage, duration, and any applicable limitations or exclusions.


Help us:

- We will make every effort to help you contact the Trade Partner's store or authorized service center for after-sales requirements.

- We will provide you with relevant information and facilitate communication between you and the Trade Partner Store/Authorized Center to address any concerns or warranty claims.

- Please note that our responsibility is limited to providing information and facilitating communication for after-sales requirements. Specifically defined terms and conditions for repairs, maintenance and warranty claims are under the care of the trade partner's store or manufacturer.



Valid reasons to return the item:


- All decisions regarding returns will be at the discretion of Samama in accordance with Samama's internal return policy, and this decision will be final and binding.


- Samama cannot guarantee the quality of products delivered by third-party merchants. If you believe that your item may be subject to a manufacturing defect, you can contact us at any time, and we will be happy to provide the necessary assistance. To return the item, the customer must fulfill one of the categories listed below:


- The item you have has a manufacturing defect. A manufacturing defect is damage caused by an error by the merchant. Examples of manufacturing issues include defects in materials, design, and/or workmanship.


- Your existing item is damaged (i.e., physically destroyed or broken) / defective (e.g., unable to operate).


- Your existing item is incomplete (i.e., missing elements and/or extensions).


- The item you have is incorrect (i.e. wrong product/size/color, counterfeit, or expired).


- The item you have does not match the product description or image (i.e. the item is not as advertised).

- Your existing item is not suitable (i.e., the size is not appropriate).


- Samama reserves the right to immediately suspend or terminate any refund without prior notice if the refund violates the terms and conditions of this return policy or in case of suspicious activities, misrepresentation by the customer, and fraudulent activities.


- You agree to indemnify Samama for any and all claims, suits, obligations, judgments, losses and damages arising out of or in connection with any claim or suit relating to this Return Policy.


- We reserve the right to modify or update this return policy at any time.
